K.I.D.S. IQ Project is a “doing business as” name for International KS Foundation. Any person (either acting on their own behalf or on the behalf of another person) accessing, browsing or otherwise using the K.I.D.S. IQ Project (“K.I.D.S.”, “K.I.D.S. IQ”, “we”, “our” and “us”) website located at https://kidsiqproject.wpengine.com (“Site”), either manually or via an automated device or program, to the extent permitted hereunder, shall be considered a “User” under this Privacy Policy. All Users are bound by the terms of this Privacy Policy. K.I.D.S. IQ is committed to protecting the privacy of our Users. This Privacy Policy discloses the privacy practices governing the use of information submitted to K.I.D.S. IQ through this Site. Capitalized and defined terms shall have the meaning designated in this Privacy Policy.

The Information We Collect, How We Use It and Who We Share It With

Browsing Information

You can browse the Site without revealing certain Personal Information and Personal Health Information, both as defined below, that can be used to identify you. K.I.D.S. IQ may collect such information including your Internet Protocol (“IP”) address, the name of the domain you used to access the Internet, the website you came from and the website you visit next (see “How We Use It,” below). However, K.I.D.S. IQ does not associate any of this browsing information with records containing any Personal Information and Personal Health Information submitted to us, so you remain anonymous when you browse the Site.

Personal and Health Information

K.I.D.S. IQ may collect personal information such as names, dates of birth, company names, titles, addresses, telephone numbers, fax numbers, e-mail addresses, photos and payment information (such as credit card numbers) (“Personal Information”), as well as health data, photos, medical history and genetics reports (“Personal Health Information”) from Users. For example, K.I.D.S. IQ may collect Personal Information and Personal Health Information submitted through online forms, electronic communications, newsletter signup and event registration and donation forms. By submitting Personal Information and Personal Health Information to this Site, the User acknowledges that he or she has read this Privacy Policy, understands it, agrees to its terms and authorizes K.I.D.S. IQ to collect, use and disclose personal information pursuant to the terms of this Privacy Policy.

How We Use It

Browsing information, including your IP address, may be used to gather broad demographic information. This information may be aggregated to measure the number of visits, average time spent, page views and other statistics about users of the Site. We also may use this data to monitor Site performance and to make the Site easier and more convenient to use. K.I.D.S. IQ uses Personal Information collected from Users, such as names and e-mail addresses, to respond to User inquiries, to communicate with Users on a regular basis through a newsletter or webinars, to process User applications for grants or participation in K.I.D.S. IQ programs, to process User donations, to help organize fund-raising events and to inform Users of new programs and services. K.I.D.S. IQ uses Personal Health Information to track patient populations and better understand patient phenotypes in furtherance of its mission, to communicate with Users on a regular basis through a newsletter or webinars and to promote syndrome awareness.

Who We Share It With

1. Personal Information (Excluding Personal Health Information)

Unless we have your consent or except as required by law, K.I.D.S. IQ will not share your Personal Information such as names and addresses with any person or entity other than those affiliated with K.I.D.S. IQ or acting on behalf of/with K.I.D.S. IQ. By submitting Personal Information through the Site, you authorize K.I.D.S. IQ to share this Personal Information for the purposes identified, such as sending newsletters through third parties, hosting webinars through third parties, determining qualifications for grants, organizing fund-raising events, responding to User inquiries, processing donations, assisting researchers or determining eligibility for K.I.D.S. IQ programs. If you do not want K.I.D.S. IQ to disclose your Personal Information to third parties, you may opt-out by submitting a written request to K.I.D.S. IQ at K.I.D.S. IQ Project, P.O. Box 1127, Toronto Dominion, Toronto, ON, Canada, M5K 1P2, Attn: Privacy Officer, or by sending an email to privacy@kidsIQproject.org. If you opt-out, you may not be able to participate in or qualify for K.I.D.S. IQ grants, or fund-raising events or programs, you may not receive the information you requested, and K.I.D.S. IQ may not be able to inform you of new programs, events, developments, products and services.

2. Personal Health Information

Coded Personal Health Information is stripped of direct identifiers such as names and addresses but, in each case, is assigned a numeric ID or code; this numeric ID or code is still linked to identifiable information, however, such linkages are not known to intended recipients of coded Personal Health Information. K.I.D.S. IQ may utilize third party service providers, such as email, website and database hosting companies, acting on behalf of K.I.D.S. IQ, to collect, store or share Patient Health Information that is not coded. If your consent is provided, Patient Health Information that is not coded may also be shared with individuals, families, researchers or others (as specified at the time of such consent). Once Patient Health Information is coded, K.I.D.S. IQ may share/publish such coded Personal Health Information on its Site, in addition to sharing it with researchers, entities affiliated with K.I.D.S. IQ or acting on behalf of/with K.I.D.S. IQ and relevant third parties such as K.I.D.S. IQ program participants and grant providers. By submitting Personal Health Information through the Site, you authorize K.I.D.S. IQ to share this coded Personal Health Information for the purposes identified, such as determining qualifications for grants, promoting syndrome awareness, organizing fundraising events, responding to User inquiries, processing donations, assisting researchers or determining eligibility for K.I.D.S. IQ programs. Once coded Personal Health Information is shared with an entity or person as it relates to the aforementioned purposes, it may then in turn be reproduced in an original or derivative format and shared publicly, for example, through the publication of a scientific/academic research paper. If you do not want K.I.D.S. IQ to disclose your coded information to third parties as described above, you may opt-out by submitting a written request to K.I.D.S. IQ at K.I.D.S. IQ Project, P.O. Box 1127, Toronto Dominion, Toronto, ON, Canada, M5K 1P2, Attn: Privacy Officer, or by sending an email to privacy@kidsIQproject.org. If you opt-out, you may not be able to participate in or qualify for research or related projects, you may not receive the information you requested and K.I.D.S. IQ may not be able to inform you of new programs, events, developments, products and services.

3. Legal and Regulatory

Notwithstanding other provisions of this Privacy Policy, we may disclose Personal Information or Personal Health Information in special cases when we have found it necessary to identify, contact or bring legal action against someone who may be violating any user agreement or may be causing injury to or interference with K.I.D.S. IQ, its Users, or anyone else that could be harmed by such activities. K.I.D.S. IQ reserves the right to disclose your Personal Information and Personal Health Information as explicitly set forth in this Privacy Policy or any user agreement agreed to by you, or as otherwise required by government or law enforcement officials. K.I.D.S. IQ can, and you hereby authorize us to, disclose any information to law enforcement or other parties that K.I.D.S. IQ in its sole discretion, believes is required or appropriate in order to comply with the law.

Applicable Law/International Issues

Because we are committed to protecting your privacy, Personal Information and Personal Health Information that is submitted to this Site will be collected, processed, stored, disclosed and disposed of in accordance with applicable Canadian law. If you are a non-Canadian user, you acknowledge and agree that we may collect and use your Personal Information and Personal Health Information and disclose it to other entities, as discussed above in “Who We Share It With,” outside your resident jurisdiction.

Personal Information and Personal Health Information may be stored on servers located inside or outside of Canada. U.S. or other international laws may not provide the degree of protection for personal information that is available in Canada. You may request not to be contacted by K.I.D.S. IQ in connection with any services, newsletters, webinars, updates, programs or promotions. Requests not to be contacted by K.I.D.S. Security

This Site has security measures in place and utilizes third-party service providers to protect against the loss, misuse and alteration of information under our control.
